Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of intekit.com, our online store, customer accounts, content, applications, connected features, customer support, and other services we make available (collectively, the “Services”).

Throughout these Terms, “Intekit,” “we,” “us,” and “our” refer to the operator of the Intekit store. “You” refers to the person or entity accessing the Services or purchasing a product.

By accessing the Services, creating an account, submitting an order, or clicking to accept these Terms, you agree to be bound by these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and Services to you. Your use of certain Shopify-powered features may also be subject to Shopify’s applicable terms and policies.

Eligibility and Customer Accounts

You must be legally capable of entering into a binding contract in your jurisdiction to make a purchase. If you use the Services for a company or other organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for providing accurate, current, and complete account, billing, shipping, and contact information. You are also responsible for protecting your account credentials and for activity occurring through your account.

Notify us promptly if you suspect unauthorized account activity. We may suspend or restrict an account where reasonably necessary to protect customers, Intekit, or the security of the Services.

Product Information and Availability

We work to present product descriptions, specifications, compatibility information, colors, images, availability, and pricing as accurately as reasonably possible. Screen settings, lighting, production tolerances, software updates, and packaging revisions may cause minor differences from online images or descriptions.

Product information may be corrected or updated without prior notice. We may modify, discontinue, limit, or replace products or Services at any time, subject to our obligations for orders already accepted and applicable law.

Availability displayed online is not a guarantee that an item will remain available before order acceptance. Product purchase quantities may be limited to prevent fraud, unauthorized resale, inventory abuse, or misuse of promotions.

Orders, Acceptance, Pricing, and Payment

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. Unless applicable law requires otherwise, acceptance occurs when we confirm shipment or otherwise expressly accept the order.

We may reject, limit, or cancel an order before shipment for reasons including product unavailability, incorrect pricing or product information, suspected fraud, payment failure, unsupported delivery address, quantity limits, sanctions or export restrictions, or other legitimate business reasons. Amounts collected for a canceled, unshipped order will be refunded to the original payment method as required by law.

Prices are shown in the currency indicated on the website and may change without notice. The price charged is generally the price displayed when the order is submitted, subject to correction of obvious errors. Applicable sales tax, shipping, and remote-area surcharges will be shown at checkout or communicated before shipment where they cannot be calculated automatically.

You authorize Intekit and its payment processors to charge the selected payment method for the order total. You represent that you are authorized to use that payment method and agree to provide additional verification when reasonably requested.

Shipping, Delivery, Returns, and Refunds

Intekit currently ships only to eligible physical addresses in the contiguous United States. We do not ship to Alaska, Hawaii, Puerto Rico, other U.S. territories, P.O. Boxes, or destinations outside the United States.

In-stock orders are normally processed within 1–2 business days, and standard delivery normally takes approximately 3–7 business days after shipment. These are estimates rather than guaranteed delivery dates. Remote or extended-service locations may require additional time and a Remote Area Surcharge.

If we cannot ship within the promised or legally required time, we will provide the notice, cancellation opportunity, consent request, or refund required by applicable law.

Returns, exchanges, refunds, damaged shipments, and missing items are governed by our Return & Refund Policy and Shipping Policy. Those policies are incorporated into these Terms.

Compatibility, Installation, and Safe Use

You are responsible for confirming product suitability before ordering and installation. Compatibility depends on factors including voltage, fixture model, fixture condition, internal dimensions, bulb base, niche, transformer, wiring arrangement, controller type, system configuration, and applicable electrical requirements.

Installation, inspection, maintenance, and repair must follow the applicable product manual, safety warnings, local electrical codes, pool and spa codes, and other legal requirements. Use a licensed electrician or qualified pool professional whenever required or whenever you are uncertain.

Disconnect and verify power before installation or service. Never install or operate a visibly damaged, water-compromised, incorrectly rated, or incompatible electrical product.

Product recommendations and compatibility references are general guidance and do not replace physical measurement, electrical verification, professional inspection, or the instructions of the fixture manufacturer. References to third-party brands do not imply endorsement or affiliation.

Wait until all products have arrived and been inspected before scheduling installation. Except where required by law or expressly agreed in writing, Intekit is not responsible for installer charges, missed appointments, pool downtime, water removal, fixture access, labor, or other incidental service costs.

App, Software, Firmware, and Connected Services

Subject to these Terms and any additional license terms, Intekit grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to use Intekit software, firmware, applications, and connected features solely with compatible Intekit products for their intended purposes.

Connected features may depend on a compatible device, local network, internet connection, mobile operating system, third-party voice assistant, cloud provider, or other service outside our control. Availability, performance, and supported integrations may change over time.

We may provide updates required for security, reliability, compatibility, compliance, or feature improvement. Some functions may not operate correctly if required updates are not installed.

Open-source components, if any, are governed by their applicable open-source licenses. Those licenses control regarding the relevant components in the event of conflict.

Acceptable Use and Prohibited Conduct

You may not use the Services to:

• Violate any applicable law, regulation, court order, or third-party right.
• Commit fraud, submit false information, impersonate another person, or make unauthorized purchases.
• Distribute malware, interfere with security, probe systems, or disrupt the Services.
• Scrape, harvest, copy, index, or commercially exploit substantial website content or data without permission.
• Reverse engineer, decompile, disassemble, decode, or circumvent technical restrictions, except where applicable law expressly permits it.
• Use the Services or Intekit materials to develop or market counterfeit, infringing, unsafe, or misleading products.
• Submit content that is unlawful, deceptive, defamatory, abusive, infringing, or harmful.
• Resell products in a misleading manner or claim an affiliation, authorization, warranty status, or certification not granted by Intekit.
• Abuse discounts, promotions, returns, chargebacks, reviews, referral programs, or affiliate programs.

We may investigate suspected misuse and take reasonable action, including restricting access, canceling unaccepted orders, preserving evidence, or reporting unlawful conduct to relevant authorities.

Intellectual Property and Customer Content

Intekit and its licensors retain all rights in the Services, website, brand, product designs, technology, software, firmware, photographs, videos, diagrams, manuals, and other protected materials. No ownership right is transferred by website access or product purchase.

Detailed ownership and permitted-use rules are provided in our Intellectual Property Rights Policy , which is incorporated into these Terms.

If you submit reviews, feedback, photographs, videos, or other public-facing content, you retain any ownership rights you hold but grant Intekit a worldwide, non-exclusive, royalty-free license to host, reproduce, format, publish, display, translate, and distribute that content for operating, supporting, and promoting Intekit and the Services, subject to applicable law and our Privacy Policy.

Customer drawings, specifications, and confidential OEM/ODM materials are treated separately. Rights in those materials and project deliverables are governed by the applicable quotation, NDA, development agreement, purchase agreement, or other written contract.

Third-Party Services and Links

The Services may integrate with or link to third-party platforms, payment services, delivery companies, voice assistants, app stores, social networks, and websites. Third parties control their own services, terms, privacy practices, availability, and security.

Intekit is not responsible for third-party services merely because we provide a link, compatibility reference, or integration. Your use of third-party services is governed by your agreement with the applicable provider.

Limited Warranty and Warranty Claims

Any written limited warranty provided with an Intekit product or displayed on its product page is incorporated by reference and governs warranty coverage, duration, exclusions, and available remedies for that product.

Unless the written warranty or applicable law states otherwise, warranty coverage does not extend to damage caused by incorrect voltage, incompatible equipment, improper installation, unauthorized modification, accident, misuse, abuse, neglected maintenance, corrosion, water intrusion caused by the fixture or seal, external electrical events, or failure to follow instructions.

Nothing in these Terms excludes, restricts, or modifies a written warranty or an implied warranty that cannot lawfully be excluded, restricted, or modified. Warranty service may require proof of purchase, product identification, photographs, video, troubleshooting information, and return of the product for inspection.

Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, and except for an express written product warranty, the Services and website content are provided on an “as available” basis. We do not guarantee that the website, app, cloud connection, or third-party integration will always be uninterrupted, error-free, secure, or compatible with every device or system.

To the maximum extent permitted by law, Intekit and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, business opportunity, or use, arising from or related to the Services or products.

To the maximum extent permitted by law, aggregate liability arising from a particular order or product will not exceed the amount you paid to Intekit for that order or product giving rise to the claim.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Intekit and its affiliates, officers, employees, agents, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, your infringement of another party’s rights, or content you submit.

This obligation does not apply to the extent a claim results from Intekit’s own negligence, willful misconduct, or other conduct for which indemnification cannot lawfully be required.

Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary because of a material breach, unlawful activity, fraud, a security threat, abuse of the Services, or discontinuation of a Service.

Termination does not affect rights, payment obligations, accepted orders, warranties, or liabilities that arose before termination. Provisions that by their nature should survive will continue, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute terms.

Disputes, Applicable Law, and General Terms

Before starting formal proceedings, please contact us and provide a reasonable opportunity to resolve the concern informally. This does not prevent either party from seeking urgent relief or exercising rights that cannot lawfully be restricted.

These Terms are governed by the laws applicable to the entity operating the Intekit store and the transaction, without giving effect to conflict-of-law rules, except that mandatory consumer protections in your place of residence remain applicable where they cannot legally be waived.

If any provision is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver.

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, epidemic, war, civil unrest, government action, labor disruption, carrier failure, utility outage, internet failure, cyberattack, or supply interruption.

These Terms and the policies incorporated by reference form the agreement regarding the Services unless a separately signed agreement applies. A signed wholesale, distributor, OEM, ODM, development, or confidentiality agreement controls over these Terms to the extent of a direct conflict concerning its subject.

Changes to These Terms

We may update these Terms to reflect changes to our products, Services, practices, or legal obligations. Updated Terms will be posted on this page with a revised “Last updated” date.

Changes apply prospectively when posted unless applicable law requires additional notice or consent. Your continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.
