Scope of This Policy

This Intellectual Property Rights Policy explains the ownership and permitted use of intellectual property associated with Intekit, intekit.com, Intekit products, software, mobile applications, product documentation, marketing materials, and related services.

“Intellectual Property” includes copyrights, trademarks, service marks, trade names, logos, trade dress, patents, patent applications, industrial and product designs, software, firmware, source code, object code, databases, technical documentation, know-how, trade secrets, and other proprietary rights recognized under applicable law.

Ownership of Intekit Intellectual Property

Unless otherwise stated, the website and all materials made available through it are owned by, licensed to, or used with permission by Intekit and its affiliates, licensors, or content providers.

Protected materials may include:

  • The Intekit name, logos, visual identity, and product names.
  • Pool and spa lighting products, controllers, enclosures, interfaces, and ornamental designs.
  • Underwater lighting control, communication, synchronization, and signal-processing technologies.
  • Mobile applications, controller firmware, software interfaces, and related functionality.
  • Website layouts, written content, illustrations, photographs, videos, diagrams, and animations.
  • Product manuals, wiring diagrams, technical specifications, drawings, and training materials.
  • Confidential know-how, manufacturing methods, testing procedures, and non-public technical information.

All rights not expressly granted in this Policy are reserved by Intekit and the applicable rights holders.

Trademarks and Brand Use

Intekit, Intekit Plus, associated logos, product names, slogans, graphics, and other source identifiers are trademarks, service marks, trade names, or trade dress of Intekit or its licensors, whether registered or unregistered.

You may not, without prior written permission:

  • Use an Intekit mark in a company name, domain name, social-media account, advertising keyword, or product listing in a misleading manner.
  • Use a name, logo, design, or packaging style that is confusingly similar to Intekit branding.
  • Suggest sponsorship, certification, endorsement, affiliation, or authorization that Intekit has not granted.
  • Remove, obscure, alter, or replace a trademark or product identifier on an Intekit product or its packaging.
  • Use Intekit branding on counterfeit, modified, incompatible, unauthorized, or non-Intekit products.

Dealers, installers, distributors, affiliates, reviewers, and other partners may use Intekit brand assets only within the scope of a written agreement or current brand-use permission.

Patents, Product Designs, and Technology

Intekit products and services may incorporate inventions, technical solutions, control methods, communication methods, signal-processing methods, ornamental product designs, and other innovations protected by issued patents, pending patent applications, design rights, or similar protections in one or more jurisdictions.

No statement on this page should be interpreted as identifying every Intekit patent, application, design right, jurisdiction, or claim. The absence of a patent number or notice does not constitute a waiver of any available right.

Purchasing or using an Intekit product does not grant a license to manufacture, reproduce, reverse engineer, commercialize, or create competing products based on protected Intekit technology or designs, except to the extent a restriction is prohibited by applicable law.

Software, Firmware, App, and Documentation

Intekit software, firmware, applications, cloud features, interfaces, databases, and documentation are licensed, not sold. Subject to any separate end-user license terms, Intekit grants the lawful product owner a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to use them solely with compatible Intekit products for their intended purpose.

Unless permitted by applicable law or written authorization, you may not:

  • Copy, modify, translate, distribute, sublicense, rent, lease, or sell the software.
  • Reverse engineer, decompile, disassemble, decode, or attempt to derive source code or protected protocols.
  • Circumvent access controls, authentication, security measures, or technical limitations.
  • Use the software or documentation to develop, train, test, or improve a competing product or service.
  • Access or use non-public APIs, systems, firmware, or technical interfaces without authorization.

Open-source software components, if any, remain subject to their applicable open-source licenses. Those licenses control in the event of a conflict regarding the relevant component.

Prohibited Uses

Without prior written permission or another lawful basis, you may not:

  • Copy or scrape product descriptions, specifications, compatibility tables, images, reviews, videos, or website content for another commercial website, marketplace listing, database, or catalog.
  • Use automated tools to extract, index, harvest, or reproduce substantial portions of the website or its data.
  • Alter Intekit product images to misrepresent another product as an Intekit product.
  • Manufacture, market, import, distribute, or sell counterfeit or unauthorized copies of Intekit products.
  • Remove or bypass digital watermarks, metadata, proprietary notices, access controls, or anti-copying measures.
  • Use Intekit materials in a way that is unlawful, deceptive, defamatory, harmful, or likely to confuse customers.
  • Use Intekit intellectual property in machine-learning datasets, model training, synthetic product generation, or automated content systems for commercial purposes without written authorization.

Customer Designs, OEM/ODM Materials, and Submissions

You retain the ownership rights you already hold in original drawings, specifications, concepts, photographs, files, and other materials that you submit to Intekit for support, OEM, ODM, quotation, evaluation, or product-development services.

By submitting materials, you confirm that you own them or have sufficient authority to provide them. You grant Intekit a limited, non-exclusive right to access, reproduce, evaluate, modify, and share the materials internally or with necessary service providers solely to respond to your request, assess feasibility, prepare a quotation, provide support, or perform the requested services.

Ownership of project deliverables, tooling, custom designs, technical developments, and newly created intellectual property will be determined by the applicable quotation, development agreement, purchase agreement, confidentiality agreement, or other written contract.

Confidential projects: Do not send trade secrets or highly confidential information through a general website form unless appropriate confidentiality arrangements are already in place. A separately signed NDA or development agreement controls if it conflicts with this general Policy.

Third-Party Intellectual Property

Third-party product names, company names, logos, trademarks, photographs, technical references, and compatibility information belong to their respective owners.

References to third-party brands or equipment are generally provided for identification, compatibility, comparison, or informational purposes. Unless expressly stated, such references do not imply sponsorship, endorsement, affiliation, or authorization by the applicable third-party rights holder.

Intekit expects users, contractors, partners, and content contributors to respect third-party intellectual property and not submit materials they are not authorized to use.

Reporting Suspected Infringement

If you believe content on intekit.com infringes your copyright, trademark, patent, design right, or other intellectual property, contact us with:

  • Your full name, company name, email address, and telephone number.
  • Identification of the intellectual property you claim is infringed.
  • The exact URL, product listing, image, or material at issue.
  • An explanation of why you believe the use is unauthorized.
  • Evidence of ownership or authority to act for the rights holder.
  • A statement that the information supplied is accurate and submitted in good faith.

Intekit may request additional information to evaluate a report. Knowingly submitting false, misleading, or abusive claims may result in legal consequences.

Permissions and Licensing Requests

To request permission to use Intekit photographs, videos, diagrams, manuals, brand assets, product data, software, technology, or other intellectual property, contact us with a detailed description of the proposed material, purpose, audience, distribution channel, territory, and duration.

Silence or failure to respond does not constitute permission. Permission is valid only when expressly granted in writing by an authorized Intekit representative and remains subject to the stated conditions.

Enforcement, Updates, and Contact

Intekit reserves the right to investigate suspected violations, withdraw permissions, request removal of unauthorized material, suspend access, notify platforms or service providers, and pursue other remedies available under applicable law.

We may update this Policy when our products, services, business practices, or legal requirements change. The revised Policy becomes effective when posted with a new “Last updated” date.

For intellectual property questions, infringement reports, or permission requests, use the Intekit Contact Us page and include “Intellectual Property” in the subject or first line.

INTELLECTUAL PROPERTY

Provide clear details about the protected material and the use in question. Our team will review your request and respond where appropriate.
